Tool Development Liability

Can you be held liable for how others use your tools?

This is a complex question with no simple answer:

  1. Intent: Did you design the tool for malicious use?
  2. Legitimate Use: Does the tool have substantial non-infringing uses?
  3. Marketing: How do you describe and promote the tool?
  4. Access Controls: Do you restrict who can obtain it?
  5. Knowledge: Did you know it was being used illegally?

Safer Approaches:

✓ Include clear disclaimers and terms of use
✓ Don’t include illegal functionality (e.g., pre-cracked software)
✓ Open-source with permissive license (community scrutiny)
✓ Documentation emphasizes legal use
✓ Require authentication or restrict distribution

✗ Market as “undetectable hacking tool”
✗ Include exploits for unpatched vulnerabilities
✗ Sell to anyone without verification
✗ Ignore reports of illegal use
✗ Design specifically to evade law enforcement
